1. Purpose

These Terms govern access to and use of the Flockopay platform, available at flockopay.com.

2. Publisher

Flockopay SAS — Address, company registration and share capital to be completed before production.

3. Access to the service

Access to the platform requires creating a user account and full acceptance of these Terms. The user warrants the accuracy of the information provided during registration and during KYC.

4. Responsibilities

Payments are processed by Stripe Payments Europe Ltd. Flockopay acts as a technical platform facilitating integration and branding of the payment journey. Flockopay's liability is limited to providing the software layer; Stripe carries regulatory responsibility for payment processing and PSD2 compliance.

5. Compliance and anti-money-laundering

Use of the platform is subject to an identity verification (KYC) procedure compliant with Directive (EU) 2015/849 and its transpositions. Flockopay reserves the right to suspend any account that does not meet AML/CFT requirements.

6. Intellectual property

All intellectual property rights to the Flockopay platform (code, trademarks, logos, visual identity) are reserved by Flockopay SAS. Any reproduction without authorisation is forbidden.

7. Acceptable use

The user agrees not to use the platform for illegal activity, fraud, money laundering or any activity contrary to applicable regulation. Flockopay may suspend any account that breaches these rules.

8. Service availability

Flockopay aims for 99.98% availability measured over a year. Planned maintenance windows are announced at least 72 hours in advance via the console.

9. Limitation of liability

Flockopay cannot be held liable for indirect damages, loss of profit, loss of data or loss of customers. Direct liability is capped at the amounts paid by the user under the current subscription over the last twelve months.

11. Changes

Flockopay may update these Terms at any time. Users will be notified by email at least 30 days before significant changes take effect.

12. Governing law

These Terms are governed by French law. Any dispute will be brought before the competent courts of Paris.
